Terms of Service and Sale

1. Purpose and service description

These Terms of Service and Sale ("Terms") govern access to and use of the Zlobby website and application (the "Service"), available worldwide at www.zlobby.com.

Zlobby is a social network for adults sharing interests in geek culture, gaming, manga and anime. The Service is organised into two distinct worlds: a Social side (profiles, feed, lobbies, messaging) usable without enabling dating, and a Dating side that is an explicit opt-in: you turn this mode on or off at any time in your settings, and it is never enabled by default.

By creating an account or using the Service, you accept these Terms, our privacy policy, cookie policy, and refund policy.

2. Service publisher

Zlobby is published by Emeric Mathis EI (sole trader, micro-enterprise), SIREN 932 467 939, SIRET 932 467 939 00025, EU VAT FR71932467939, registered with the Avignon Trade Register on 23 June 2025. Head office: 14 rue Cassini, 84300 Cavaillon, France.

3. Eligibility and account creation

Registration is restricted to adults (18+, or the age of majority in your country of residence if higher) with the capacity to contract. When you register you agree to:

  • Provide accurate and up-to-date information (notably your date of birth);
  • Verify your email address via the link sent after sign-up;
  • Choose a strong password and keep your credentials confidential;
  • Create only one account per individual;
  • Add a profile photo during onboarding: an avatar photo is mandatory to complete sign-up and is systematically subject to automated moderation (see section 6);
  • Not impersonate anyone and not use photos of someone else without their consent;
  • Accept that your profile is visible to other adult users of the Service.

Any false statement about your age may result in immediate account deletion and, where relevant, a report to the competent authorities.

4. Acceptable use

You agree to use the Service in good faith and in compliance with applicable law. The following is strictly prohibited:

  • Publishing illegal content, child sexual abuse material, terrorist propaganda, racist, discriminatory or hateful content;
  • Explicit nudity or sexual content, violence or gore, glorification of self-harm or suicide, promotion of drugs;
  • Harassment, threats, intimidation, hate speech, or doxxing of other users;
  • Identity theft (notably via stolen photos) and catfishing;
  • Commercial solicitation, prostitution, escorting, for-profit recruitment, scams or fraud;
  • Spreading viruses, malware, phishing attempts or other security breaches;
  • Scraping, automation, creating multiple accounts, bypassing technical limits (rate-limits, premium gating);
  • Sharing external contact info (phone, Discord, Snapchat, etc.) in public spaces or profiles without mutual consent;
  • Any activity that disrupts the proper operation of the Service.

5. User content and licence

You retain ownership of the content you publish (photos, bio, posts, comments, messages, etc.). By publishing on Zlobby, you grant us a non-exclusive, worldwide, royalty-free licence, limited to the duration of your account, solely to store, display, moderate, index and enable exchange of this content within the Service.

This licence ends automatically when you delete your account or the content concerned, subject to mandatory legal retention periods (see privacy policy).

You warrant that you hold all rights necessary to the content you publish and indemnify Zlobby against any third-party claim relating to this content.

6. AI-based moderation, reporting and appeals

In accordance with the EU Digital Services Act (DSA, Regulation (EU) 2022/2065), Zlobby operates moderation combining artificial intelligence and human review:

  • Automated AI moderation of all content: posts, post images, comments, profile bios, avatar and gallery photos, private messages and lobby messages. This text and image analysis is performed via Anthropic (Claude) models, acting as a processor located in the United States under standard contractual clauses;
  • The profile photo is systematically moderated by AI from onboarding; in Dating mode, an additional check requires the photo to depict a real person;
  • A three-level decision (safe, flagged, rejected) with a confidence score; in case of doubt, content is escalated to human review;
  • A reporting mechanismaccessible from every profile, post, comment, message or photo via the "Report" menu. A report triggers a fresh AI scan that may resolve or reject the content and notifies the reporter;
  • A statement of reasons (DSA Art. 17) for any restriction: the content concerned, the reason, whether the decision was made by AI or a human, and information on your remedies;
  • A right to human review and to contest any moderation decision within 30 days (DSA Art. 14 and Art. 17; right not to be subject to a solely automated decision, GDPR Art. 22);
  • When a post is rejected by AI, any credits spent are automatically refunded to your account.

7. Sanctions for breach

In case of breach of these Terms or applicable law, depending on severity, we may apply one or more of the following measures, with or without prior notice depending on urgency:

  • Warning("strike") by notification or email, with a cumulative system;
  • Removal of the offending content;
  • Temporary limitation of certain features (messaging, posting, like);
  • Temporary suspension of the account or a lobby ban (notably for spam);
  • Permanent ban, including prohibition to create a new account. A ban triggers the automatic cancellation of any active Stripe subscription;
  • Report to authorities for criminal offences (CSAM, terrorism, serious threats, etc.).

Any moderation decision will be notified to you with its reasons, and you have a right of appeal (see section 6).

8. Paid features and subscriptions

Zlobby offers premium features via:

  • Pro and Legend subscriptions (monthly or yearly) unlocking extended features (advanced filters, see who liked you, daily credit multiplier, tier-gated cosmetics, etc.);
  • Virtual credits available as one-off purchases in the form of packs, usable for cosmetics (frames, banners, themes, Legend animated emojis) or profile/post boosts.

Payments are processed by Stripe Payments Europe Ltd (Ireland, EU), in compliance with PCI-DSS standards. Zlobby never accesses your card data and only retains the transaction identifier and amount.

Subscriptions auto-renew at the end of each period (monthly or yearly) unless cancelled beforehand. You can cancel at any timefrom "Settings > Subscription", with premium access maintained until the end of the current period. Tier-gated cosmetics (themes, Legend border) are disabled upon cancellation.

If you reside in the European Union (or a country applying equivalent rules), you generally have a 14-day right of withdrawal on new purchases not yet consumed (Directive 2011/83/EU). Full refund terms, the waiver of immediate performance for digital content, and dispute handling are detailed in our refund policy. The mandatory law of your country of residence remains applicable and prevails where it is more protective.

Zlobby reserves the right to adjust prices with 30 days' notice. Prices are shown in euros. As a French micro-enterprise, Zlobby applies the VAT franchise regime: VAT not applicable. Depending on your country of residence, local taxes may apply and be collected by our payment provider.

9. Third-party data (catalogues)

The Service integrates third-party data catalogues:

  • Video games: data and covers via IGDB (Twitch Interactive Inc.);
  • Manga and anime: data and covers via Kitsu;
  • Location and geocoding: city search and reverse-geocoding based on OpenStreetMap / Nominatim, for the distance filter.

This data may contain errors or be incomplete. Zlobby cannot be held responsible for third-party content and strives to update it regularly.

10. Account deletion and closure

You can delete your account at any time via "Settings > Delete my account". Deletion entails:

  • Immediate anonymisation of your personally identifiable information (PII);
  • Immediate revocation of all your active sessions;
  • Removal of your photos, interests, pending likes, public profile;
  • A 30-day grace period during which the account can be restored on request, after which deletion is permanent (DB + storage cascade);
  • Retention of certain data for mandatory legal reasons (Stripe transaction billing; moderation audit trail);
  • Inability to recover content after the 30-day window.

You can also export all your personal data as JSON from the same page (right to data portability, GDPR Art. 20).

11. Intellectual property

The Zlobby name and logo are registered trademarks. The design, source code and interfaces of the Service are the exclusive property of Emeric Mathis EI. Any reproduction, representation, modification or adaptation, in whole or in part, without prior written authorisation, is prohibited and constitutes infringement sanctioned under applicable copyright and trademark law.

12. Limitation of liability

Zlobby undertakes to provide the Service with good-faith quality, as an obligation of means. Zlobby cannot be held liable for:

  • Occasional interruptions for maintenance, technical issues, or force majeure;
  • Content published by other users;
  • Indirect damage (loss of opportunity, unsubstantiated moral prejudice, etc.);
  • Other users' behaviour outside the Service (in-person meetings, exchanges on other platforms).

No provision in these Terms excludes or limits Zlobby's liability for damages that cannot legally be excluded, nor does it affect your mandatory consumer rights under the law of your country of residence.

13. Amendments to these Terms

Zlobby may amend these Terms at any time to reflect legal, technical, or commercial evolution. Any material amendment will be notified to you by email and/or in-app banner at least 15 days before entry into force. Continued use of the Service after this notice constitutes acceptance.

If you refuse the new Terms, you may delete your account (cf. section 10) before they enter into force.

14. Amicable resolution and mediation

In case of dispute, please first contact us at contact@zlobby.com to seek an amicable solution.

Failing that, and if you reside in the European Union, you may use a consumer mediator free of charge. Depending on your country of residence, other remedies (local consumer-protection authorities) may be available.

15. Governing law and jurisdiction

These Terms are governed by French law, and failing amicable resolution, the French courts have jurisdiction. However, if you are a consumer, you benefit from the mandatory consumer-protection provisions of your country of residence, and you may bring proceedings before the competent courts of that country where the applicable law so provides.
